Tek Alchemy, Inc.'s Acceptable Use policy is provided to customers and all users of Tek Alchemy, Inc.'s network to explain acceptable usage of Tek Alchemy, Inc.'s resources. Tek Alchemy, Inc. reserves the right to change this Acceptable Use Policy at any time. By using Tek Alchemy, Inc.'s network all customers and users agree to be bound by the Acceptable Use Policy and the Terms of Service posted at www.tek.net.

General
Any violation of this Acceptable Use Policy may result in termination of service Customer without liability or notice to the Customer.
Customer may not use their server or web host account to post any material that Tek Alchemy, Inc. determines at its sole discretion to be unlawful, indecent, or objectionable.
Tek Alchemy, Inc. reserves the right to refuse service to anyone for any reason.

Lawful Use
All users are expected to operate within the limits of the law. Uses that would be considered in violation of this policy include but are not limited to (1) copyright infringement, the copying or distribution of copyrighted materials without permission, (2)fraud, (3)trafficking illegal substances, (4)child pornography, (5) harassment, or (6)forgery or impersonation. In the event Tek Alchemy, Inc. believes that the service is being used by the Customer in contravention with any of the terms and provisions contained in this Agreement, Tek Alchemy has the right to immediately discontinue such service to Customer without liability or notice to the Customer:

SPAM
Use of any of Tek Alchemy, Inc.'s resources for the purpose of sending or receiving responses from Unsolicited Commercial email, Unsolicited Bulk Email, or USENET Spamming is prohibited, Violations may result in immediate and permanent removal of the server from our network without liability or notice to the Customer. To report spam occurrences, email to abuse@tek.net. All SPAM complaint notices must be answered by the customer within 24 hours. Failure to answer SPAM complaints within the 24 hours will result in a $35 charge for each incident.

Pornography and IRC Servers
Pornography content is prohibited. Violations may result in immediate and permanent removal of the server from our network without liability or notice to the Customer.
IRC Servers may not be hosted on any Tek Alchemy, Inc. resources. Violations may result in immediate and permanent removal of the server from our network without liability or notice to the Customer.

Network Resources and Security
Users are prohibited from violating or attempting to violate the security of the Tek Alchemy Inc. Network, including but not limited to (1) taking any action in order to obtain data, access to data or services to which such User is not entitled (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without authorization (3) attempting to interfere with service host, network, or user or (4) forging any TCP/IP packet header or any part of the header information in any newsgroup posting or email. Violations of system or network security may result in civil or criminal liability. Tek Alchemy, Inc. will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
Excessive use or abuse of Tek Alchemy, Inc.'s shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account. Users are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of Tek Alchemy, Inc. systems or networks. Tek Alchemy reserves the right to terminate or limit such activities.

Disclaimer
Tek Alchemy is under no duty to look at each customer's or user's activities to determine if a violation of the Acceptable Use Policy has occured, nor do we assume any responsibility through our Acceptable Use Policy to monitor or police Internet-related activities. Tek Alchemy, Inc. disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person's or party's violation of this policy.
All Sub-Networks, resellers and managed servers of Tek Alchemy, Inc. must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate Cancellation.
